Beta Program

Terms of Service

This is beta software. Buildova (the “Service”) is provided to beta participants on an “as is” and “as available” basis for testing and evaluation. It may be incomplete, contain bugs, lose data, change without notice, or stop working. You take part at your own risk. Do not rely on the Service for anything business-critical, and always keep your own backups of anything you build.

1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you (“you” or “Participant”) and Buildova Ltd (“we”, “us”, “our”, or “Buildova”) governing your access to and use of the Buildova beta program, website, applications, and related services (together, the “Service”). By redeeming an invite code, creating an account, or otherwise accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

2. Nature of the beta

The Service is a pre-release beta offered for the purpose of testing, evaluation, and gathering feedback. You acknowledge and accept that:

You are responsible for maintaining independent copies and backups of any data, code, or other materials you create with or upload to the Service.

3. Eligibility & invite codes

Access to the beta is by invitation only. Invite codes are personal to you, may not be sold, shared, transferred, or published, and entitle a single account to a single beta seat. Each code must be redeemed within the period stated when it is issued (currently 30 days from issue) or it will expire. We may issue, limit, revoke, or invalidate codes at our discretion, including where we believe a code has been misused.

4. Accounts & security

To use the Service you must create an account and provide accurate information, including a valid email address and, where requested, a phone number. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. We may suspend or disable accounts that we reasonably believe are compromised or used in breach of these Terms.

5. Beta access & credits

During the beta, eligible participants receive access without paying the standard license fee, together with any build credit we make available (for example, an initial credit applied to cover the cost of building and deploying applications). Credits:

Once your beta access window opens (currently 7 days from registration), you are expected to actively build, deploy, and provide feedback. If your access window lapses without meaningful use, we may close your seat and reallocate it. Nothing in the beta obliges us to offer the Service, any pricing, or any feature on a paid or ongoing basis after the beta ends.

6. License to use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service during the beta for your own internal testing, evaluation, and development purposes. You may not: (a) resell, sublicense, or commercially exploit the Service itself; (b) copy, modify, reverse engineer, decompile, or attempt to extract the source code of the Service (as distinct from the applications you build, which are addressed below); (c) circumvent usage limits, access controls, or security measures; or (d) use the Service to build or operate a product that competes with the Service.

7. Your content & ownership

“Your Content” means the descriptions, prompts, data, and materials you submit to the Service, and the applications and source code generated for you through the Service. As between you and us, you own Your Content and the applications you build, and you may download and keep the source code. We claim no ownership over it.

You grant us a limited license to host, store, process, transmit, and display Your Content solely as needed to operate, provide, secure, and improve the Service (including passing prompts and related data to the third-party providers described below). You are solely responsible for Your Content, for having the rights to submit it, and for ensuring that it and your use of the resulting applications comply with all applicable laws. We do not pre-screen Your Content and are not responsible for it.

You are responsible for the applications you deploy, including their security, hosting, lawful operation, and any data they collect from your own end users.

You agree not to use the Service to:

9. Feedback

A core purpose of the beta is feedback. If you give us suggestions, ideas, bug reports, or other feedback about the Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable license to use, reproduce, modify, and incorporate that Feedback for any purpose, without restriction, attribution, or compensation to you. Feedback is provided voluntarily and is not confidential to you.

10. Third-party & AI services

The Service relies on third-party providers to function, including providers of artificial-intelligence model processing, hosting and infrastructure, storage, payment processing, email, and messaging. To build and run applications, Your Content (such as your prompts and project data) may be transmitted to and processed by these providers, including AI providers. Your use of the Service is also subject to those providers’ terms where applicable. We are not responsible for third-party services, and their availability or behaviour is outside our control. 11. Confidentiality

The beta may give you access to non-public features, pricing, performance information, and other materials that are confidential to us (“Confidential Information”). You agree to keep Confidential Information confidential, to use it only to participate in the beta, and not to disclose it to third parties, except where it is or becomes public through no fault of yours, or where disclosure is legally required.

12. Availability & changes

We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice. We may also change these Terms; if we make material changes we will take reasonable steps to notify participants (for example, by email or an on-site notice). Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Term & termination

These Terms apply while you have access to the Service. We may suspend or terminate your access at any time, with or without cause and with or without notice, including at the end of the beta. You may stop using the Service at any time. Before your access ends, you are responsible for downloading and exporting any of Your Content you wish to keep. On termination, the licenses we grant you end, but the sections that by their nature should survive (including ownership, Feedback, disclaimers, limitation of liability, indemnification, and general terms) will continue to apply.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF DATA LOSS, OR THAT ANY OUTPUT WILL BE ACCURATE OR RELIABLE. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE THE SERVICE IS PROVIDED FREE OF CHARGE DURING THE BETA, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR £100. These limitations apply to the maximum extent permitted by law and do not affect any non-excludable statutory rights.

16. Indemnification

You agree to indemnify, defend, and hold harmless Buildova Ltd and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content or the applications you build or deploy; (b) your use or misuse of the Service; (c) your breach of these Terms or any law; or (d) your violation of the rights of any third party.

17. General terms

Governing law. These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, and the courts of England and Wales will have exclusive jurisdiction, except where mandatory local law provides otherwise.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements. Severability. If any provision is found unenforceable, the remaining provisions stay in effect. Waiver. Our failure to enforce a provision is not a waiver. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. No partnership. Nothing here creates a partnership, agency, or employment relationship.
